1. The service

The program or the guide is developed with the help of Kajabi’s service. Kajabi is a service for creation of web-based courses and guides that are distributed electronically. The service allows businesses to create create online courses consisting of video, text, images, audio, and interactive features. The service includes hosting and operating the spirit of the platform, support and in some cases even a shop for the sale and presentation of the courses.

Kajabi reserves the right to change these terms and conditions on this page and the conditions will be applied.

After having completed the purchase of a guide or course produced by Kajabi’s service and through the presentation page developed by Kajabi’s tool, you will be given access to the material. As a part of purchase process, you register a customer account to study the material through Kajabi’s service or use a previously registered account. When the purchase is processed, you will enter Kajabi’s services and can view the material. To access the material please log in through the site.

Creation of customer account is permitted only with a valid email address. You are responsible for the email address stated is correct and active. You can change the email address stated under “Settings”.

To register in Kajabi you must be over 18 years.

2. Payment

To purchase the program you have 2 options depending on what country you visit our store from:

Option 1 . Payment through PayPal

We are using PayPal as a third party payment option for card payments. All sensitive information, such as credit card information is handled by Paypal using a secure payment and SSL server. Kajabi don't store any card information. We accept Visa, MasterCard and AMEX. You can read Paypal General Terms and Conditions and Privacy by each link.

Option 2 . Card payment through Stripe

We are using Stripe as a third party payment option for card payments. All sensitive information, such as credit card information is handled by Stripe using a secure payment and SSL server. 3. Returns

When you buy a program or a guide, the purchase does not apply to e-commerce law. When the payment has been processed and you get access to material, your right to withdrawal is exhausted. Is the product defective or incorrect, you are welcome to contact our customer service department at [email protected].

4. Technical conditions

The service requires access to the Internet. You are responsible for the costs incurred in the use of internet.

5. Responsibility

When buying a course or a guide access is only granted to the person who bought it. You may not in any way spread further content to others or share the password to your account.

6. Kajabi

Material purchased through Kajabi is available around the clock, seven days a week. Kajabi, however, does not guarantee that the service is always free of errors or interruptions. If the deficiencies or interruption in service occurs, Kajabi reserves the right to correct them without breach of contract. Kajabi also reserves the right, with reason, to close the service for upgrades and maintenance.

7. Disclaimer

Kajabi is a service to publish material in the form of courses and guides. Through the service, customers of Kajabi sell courses and guides, either through their own websites, other sales channels or where a presentation page is included in Kajabi's service. Sales are made through this page and are managed via Kajabi's accounts at Stripe and PayPal. Kajabi is not responsible for any disputes, claims, losses or damages of any kind that may arise from documents or information that are implemented and shared by Kajabi’s customers or participants in customer courses and guides.

We do not control the content of the materials submitted by our customers and do not guarantee in any way validity or accuracy of the content. As a buyer of courses or guides you acknowledge that you may be exposed to offensive or inappropriate content and understand that Kajabi bears no responsibility of this type of content and assume no responsibility for the content itself.

Via Kajabi you can access links to third party sites either by the tool itself or the material that clients has provided. Kajabi take no responsibility for these third-party sites and do not control them in any way. As a user of Kajabi should take appropriate steps to assess whether it is advisable to visit such third party site and protect your own personal information and privacy at such a page.

8. Freedom of choice

Any dispute under these terms shall be governed by United States law in the California District Court.

9. Personal data

To register in Kajabi’s service requires only an e-mail address and first and last name. When you provide your personal details, you agree that we store and use your information in our business to fulfill the contract against you. In this part we will inform you of updates that occur in the material you have access to and for general updates to the service.

You also admit that we share this personal data with the customer who is the provider of the course content. These customers may use this information to contact you for other purposes. It is your responsibility as a user to ensure what the customer will do with this information and how it will be stored. Kajabi does not control the uses or how this information is stored by our Customers.

Upon deregistration of your Kajabi account Kajabi will delete all information of you. However, it is your responsibility to inform the Customers whose material you have purchased as well. You have the right to request a deregistration, correction of potentially wrong data in regards to you. This has to be done in via email to [email protected]. You can also lock the access of your user data for marketing done by the Customer.

Access Duration:

1. The Course access period begins from the date of enrollment and continues for a duration of one year ("Access Period").
2. After the Access Period, your access to the Course will be automatically terminated, and you will no longer have access to the Course materials or any associated content.

Course Materials:

1. All Course materials, including but not limited to videos, documents, quizzes, and other related content, are the intellectual property of the Provider or its licensors and are protected by copyright laws.
2. During the Access Period, you may use the Course materials for personal and non-commercial purposes only. You agree not to reproduce, distribute, modify, display, perform, or create derivative works of the Course materials without the explicit written consent of the Provider.

Course Enrollment:

To access the Course, you must complete the enrollment process and pay the applicable Course fees, if any.

1. 1. The Provider reserves the right to refuse or revoke enrollment to the Course at its sole discretion, with or without cause.

2. User Account:

   1. During the enrollment process, you may be required to create a user account ("Account").
   2. You are responsible for maintaining the confidentiality of your Account login credentials and are solely responsible for all activities that occur under your Account.

3. Course Usage and Conduct:

   1. You agree not to use the Course for any unlawful, harmful, or inappropriate purposes.
   2. You must not share your Course access with others or permit unauthorized individuals to access the Course using your Account.

4. Technical Requirements:

   1. You are responsible for ensuring that you have the necessary hardware, software, and internet connection to access and use the Course materials effectively.
   2. The Provider is not responsible for any technical issues, limitations, or interruptions that may affect your ability to access the Course.

5. Refund Policy:

   1. Refunds are subject to the Provider's refund policy, if applicable, and will be governed by the terms outlined in the refund policy.
   2. NO REFUNDS 

6. Termination:

   1. The Provider reserves the right to terminate or suspend your access to the Course at any time, with or without notice, in case of violation of these Terms or any other policies associated with the Course.

7. Limitation of Liability:

   1. The Provider shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising from or in connection with your use of the Course materials or any associated content.

8. Modifications to Terms:

   1. The Provider may update or modify these Terms at its discretion. Any changes will be effective immediately upon posting the revised Terms on the Provider's website or platform. Your continued use of the Course after such modifications will signify your acceptance of the updated Terms.

9. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of laws principles.

MASSAGE DISCLOSURE: THE MASSAGE IS A PROCESS, AND SUBSEQUENT VISITS MAY BE NECESSARY IN ORDER TO ACHIEVE THE DESIRED RESULTS. ACTUAL RESULTS VARY FROM PERSON TO PERSON. IULIIA DIUMEA DOES NOT GUARANTEE ANY SPECIFIC RESULT. 

RELEASE: I RECOGNIZE THAT THERE ARE CERTAIN INHERENT RISKS ASSOCIATED WITH DEEP TISSUE MASSAGE   ABOVE, AND I ASSUME FULL RESPONSIBILITY FOR THE PERSONAL INJURY TO MYSELF. IN EXCHANGE FOR  DEEP TISSUE MASSAGES, I HEREBY FULLY RELEASE AND FULLY DISCHARGE IULIIA DIUMEA FROM ANY AND  ALL DAMAGES, COSTS, EXPENSES, LIABILITIES, CAUSE OF ACTION, CLAIMS, AND DEMANDS OF WHATEVER  CHARACTER IN LAW OR EQUITY, WHETHER KNOWN OR UNKNOWN, DIRECT OR INDIRECT, ASSERTED OR  UNASSERTED  AND WHETHER OR NOT IN ACCOUNT OF MYSELF OR IULIIA DIUMEA OR OTHER THIRD PARTIES  WHOSE CLAIMS MAY ARISE OUT OF, OR RELATE TO, THE MASSAGE I HAVE REQUESTED IULIIA DIUMEA TO TEACH ME TO PERFORM. IT IS THE INTENTION OF THE PARTIES THAT THIS AGREEMENT BINDS ALL PARTIES WHOSE CLAIMS MAY ARISE OUT OF, OR RELATE TO, THE MASSAGE TEACHINGS PROVIDED BY IULIIA DIUMEA, INCLUDING ANY SPOUSE OR HEIRS OF THE CLIENT/PATIENT AND ANY CHILDREN, WHETHERBORN OR UNBORN. ANY LEGAL OR EQUITABLE CLAIM THAT MAY ARISE FRON PARTICIPATION SHALL BE RESOLVED UNDER CALIFORNIA LAW.  

IDEMNIFICATION: I AGREE TO IDEMNIFY, HOLD HARMLESS AND IULIIA DIUMEA AGAINST ALL THIRD PARTY CLAIMS, CAUSES OF ACTION, DAMAGES, JUDGEMENTS, COSTS OR EXPENSES,INCLUDING ATTORNEY’S FEES AND ANY OTHER LITIGATION COSTS, WHICH MAY IN ANY WAY ARISE FROM THE ABOVE DESCRIBED  TREATMENT  I GAVE REQUESTED IULIIA DIUMEA TO PERFORM.  

ARBITRATION : IT IS UNDERSTOOD THAT ANY DISPUTE ARISING AS TO MALPRACTICE OF MASSAGE TREATMENT SHALL BE DECIDED BY A NEUTRAL ARBITRATOR. ANY ARBITRATION  WILL BE GOVERNED BY  

CALIFORNIA ARBITRATION STATUTES.THE FEES FOR THE ARBITRATOR WILL BE SPLIT PRO-RATA AMONG THE  PARTIES AND EACH PARTY WILL BE RESPONSIBLE FOR THEIR OWN ATTORNEY’S FEES AND COSTS. ANY ACTION TO COLLECT FEES FROM THE CLIENT/PATIENT FOR THE TREATMENTS PERFORMED MAY BE BROUGHT IN ANY  COURT LOCATED IN CALIFORNIA AND PREVAILING PART.IN SUCH COLLECTION, ACTIONS SHALL BE ENTITLED  TO RECOVER ANY REASONABLE ATTORNEY’S FEES AND COSTS. FILING OF ANY ACTION IN ANY COURT  TO COLLECT ANY FEE FROM CLIENT/PATIENT SHALL NOR WAIVE THE RIGHT TO COMPLETE ARBITRATION OF ANY MALPRACTICE CLAIM.  

RESULTS: I AGREE THAT RESULTS ARE SUBJECTIVE AND THAT MY LIFESTYLE CAN MITIGATE THESE RESULTS.   

BY SIGNING THIS AGREEMENT, I CONFIRM THAT I AM OVER THE AGE OF 18. I UNDERSTAND THAT THE MASSAGE IS PERMANENT, THAT SUCH MASSAGE HAS POSSIBLE ADVERSE CONSEQUENCES, AND THAT THE MASSAGE IS FOR COSMETIC PURPOSES ONLY.   

I CERTIFY THAT I HAVE READ THE ABOVE PARAGRAPHS, FULLY UNDERSTAND THE PROCEDURE’S RISKS AND  HEREBY CONSENT TO THE MASSAGES. THIS MEANS THAT I ACCEPT FULL RESPONSIBILITY FOR THESE AND/OR ANY OTHER COMPLICATIONS WHICH MAY ARISE OR RESULT DURING OR FOLLOWING THE MASSAGE, WHlCH lS TO BE PERFORMED AT MY REQUEST. ACCORDING TO THIS AGREEMENT,I HEREBY AGREE TO ARBITRATION OF ANY MALPRACTICE  CLAIM. 

I FURTHER UNDERSTAND THAT THE COST OF THESE MASSAGE COURSE ARE NONREFUNDABLE AND THAT BY SIGNING THIS AGREEMENT,  I VOLUNTARY SURRENDER CERTAIN LEGAL RIGHTS.
